Terms of Service

1. Agreement to these terms
These Terms of Service ("Terms") govern your use of the MoneyEdu.kids educational games and website (the "Service"), operated by Decision Partners LLC ("we," "us," or "our") and offered to you through a financial institution that licenses it. By using the Service, you agree to these Terms. Because the Service is intended for children, a parent or guardian should review these Terms; if a child uses the Service, the parent or guardian accepts these Terms on the child's behalf and agrees to supervise the child's use. If you do not agree to these Terms, do not use the Service.
2. What the Service is
The Service is a set of browser-based games that teach financial-literacy concepts to children ages 7 to 12. It is designed to be used by a child together with a parent or another trusted adult. No account or sign-in is required.
3. Educational purpose only; not financial advice
The Service is provided for educational and entertainment purposes only. It uses simplified simulations to illustrate general money concepts. It is not financial, investment, tax, accounting, or legal advice, and it is not a recommendation to take any particular financial action. Game scenarios, numbers, and outcomes are illustrative and do not reflect real markets, products, rates, or returns. For decisions about real money, consult a qualified professional or your financial institution.
4. Acceptable use
You agree to use the Service only for its intended, lawful, personal, non-commercial, educational purpose. You agree not to: misuse, disrupt, or overload the Service or its servers; attempt to gain unauthorized access to any system or data; probe, scan, or test the vulnerability of the Service; copy, scrape, or harvest content except as these Terms allow; reverse engineer, decompile, or attempt to extract source code, except to the extent the law permits despite this restriction; remove or alter any notices; or use the Service in any way that infringes the rights of others or violates the law.
5. Intellectual property
The Service, including the games, software, code, designs, artwork, text, and other content, is owned by Decision Partners LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for its intended educational purpose. All rights not expressly granted are reserved. The name and logo of your financial institution are the property of that institution and are used with its authorization; nothing in these Terms grants you any rights to them.
6. Third-party services and links
The Service does not include or rely on third-party services and does not link to third-party websites.
7. Privacy
Our handling of information is described in our Privacy Policy, which is incorporated into these Terms by reference.
8. Availability and changes to the Service
We may change, suspend, or discontinue the Service or any part of it at any time, and we may set limits on or restrict access to it, without liability. We do not guarantee that the Service will be available, uninterrupted, or error-free.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE ERROR-FREE OR SECURE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Decision Partners LLC AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
11. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Decision Partners LLC and its affiliates from claims, damages, and reasonable expenses arising out of your misuse of the Service or your violation of these Terms or applicable law.
12. Governing law and disputes
These Terms are governed by the laws of the State of MA, without regard to its conflict-of-laws rules. The state and federal courts located in Middlesex County, MA will have exclusive jurisdiction over any dispute arising out of these Terms, and you and we consent to that jurisdiction and venue.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
14. Relationship with your financial institution
The Service is operated by Decision Partners LLC. Your financial institution offers you access to the Service but does not operate it, and your financial institution's own terms may also apply to your membership relationship with it.
